In a landmark decision, the Supreme Court of India has observed that Muslim women have the right to seek maintenance from their husbands under Section 125 of the Criminal Procedure Code (CrPC). This decision reinforces the rights of divorced Muslim women, ensuring they receive the support they need for a dignified life.
BJP leader Mohsin Raza expressed strong support for the Supreme Court’s decision, emphasizing its significance for the welfare of divorced Muslim women. “We welcome this decision of the Supreme Court. A decision has come for all divorced Muslim women. They too have a right to live, where will they go when you divorce and abandon them, and do not provide them maintenance?” Raza stated to ANI. He further assured that the Modi-led NDA Government stands firmly behind this decision and will not overturn it, highlighting the administration’s commitment to public interest.
The ruling addresses a critical issue faced by many divorced Muslim women who have been left without any financial support after their marriages ended. The Supreme Court’s decision ensures that these women can now seek legal recourse to secure maintenance, providing them with much-needed financial stability.
Section 125 of the CrPC mandates that a person with sufficient means must provide maintenance to his wife, children, and parents if they cannot maintain themselves.
