The Mira Bhayandar Vasai Virar (MBVV) police have charged Adesh Bansode, an advocate and Maharashtra secretary of the Communist Party of India (Marxist-Leninist) Liberation, for sharing a YouTube video by Dhruv Rathee that criticizes Prime Minister Narendra Modi. This incident occurred in a WhatsApp group of the Bar Association of Vasai.
According to an Indian Express report, Bansode posted the link to the video titled "Mind of a Dictator" on May 20, coinciding with the 5th phase of the polling. He urged group members to ?Do watch the video before going to vote.?
One lawyer in the group reported Bansode to the police for sharing the video. Subsequently, the MBVV police filed a suo motu complaint and registered an FIR on May 21. The FIR claims the video violated prohibitory orders issued by the Commissioner of Police, which were meant to prevent misinformation and undue influence on voters during the election period.
MBVV Commissioner Madhukar Pandey had issued these prohibitory orders to ensure smooth election proceedings from May 18 to May 20. The FIR alleges that the video's message contained false claims about candidates and attempted to influence voters.
Advocate Bansode has called the FIR illegal, arguing that the police did not follow the correct legal procedures before filing charges under Section 188 of the Indian Penal Code. Senior Police Inspector Raju Mane of Manikpur stated to Mid Day that all procedures were adhered to and confirmed that the video shared by Bansode was critical of PM Modi.
