'30-Day Arrest = Removal Of An Elected CM. No Trial, No Conviction — Just BJP’s DIKTAT': TN CM MK Stalin Slams 130th Constitutional Amendment

Tamil Nadu Chief Minister MK Stalin has strongly criticized the recently introduced 130th Constitutional Amendment, describing it as a “black day” for India’s democratic framework. He alleged that the amendment undermines the core principles of democracy and amounts to an authoritarian diktat by the Union government led by the BJP.

Stalin pointed out that under the amendment, elected leaders—including Chief Ministers—could be removed from office after a 30-day arrest, even without conviction or completion of trial.

In a series of posts on X, the Chief Minister wrote, “30-day arrest = Removal of an elected CM. No trial, no conviction — just BJP’s DIKTAT.” He further warned that such laws could mark the beginning of dictatorial governance, where votes are manipulated, opposition voices silenced, and state governments crushed.

Linking the bill to recent allegations of vote manipulation, Stalin claimed that the BJP’s mandate was already under scrutiny and that the amendment is a deliberate attempt to distract public attention. “Having allegedly stolen the mandate of the people, the BJP is now trying to push the 130th Constitutional Amendment Bill to shift focus from these exposés,” he said.

The Chief Minister urged all democratic parties and civil society to unite in opposition, asserting that the bill is unconstitutional and will likely face judicial challenges. He emphasized that guilt must be determined through proper trial, not merely based on arrest.

The amendment was introduced in the Lok Sabha on Wednesday by Home Minister Amit Shah, along with two other bills, proposing that the Prime Minister or state Chief Ministers could be removed if arrested for 30 consecutive days. The bills have now been referred to a joint parliamentary committee for detailed scrutiny.
