Lok Sabha Erupts As Amit Shah Introduces Controversial Bills Threatening Removal Of MPs, CMs, Union Ministers

A fiery and chaotic session unfolded in the Lok Sabha on Wednesday as Union Home Minister Amit Shah introduced three highly controversial bills that propose the removal of elected representatives—including the Prime Minister, Chief Ministers, and Union Ministers—if arrested or detained for 30 consecutive days on serious criminal charges.

The bills introduced were the Constitution (130th Amendment) Bill, 2025, the Government of Union Territories (Amendment) Bill, 2025, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2025. The announcement triggered massive uproar in the House, with opposition lawmakers accusing the BJP-led NDA government of attempting to destabilise non-BJP state governments. Shah, however, assured MPs that the bills will be sent to a Joint Parliamentary Committee (JPC), which will include members from both the ruling party and the opposition for detailed scrutiny.

Opposition MPs React:

AIMIM MP Asaduddin Owaisi condemned the bills, stating they violate the “principle of separation of powers” and undermine the people’s right to elect a government. He added that the legislation could allow executive agencies to act as “judge and executioner based on flimsy allegations and suspicions.” Owaisi accused the government of attempting to turn India into a “Police State” and described the bills as a death blow to elected governments.

Congress MP Manish Tewari also slammed the bills, calling them destructive. He warned that the legislation would effectively make executive officers the “boss” of the Prime Minister and other elected leaders. “The Constitution guarantees the rule of law, and the basis of that is being innocent until proven guilty. These bills seek to overturn that principle,” Tewari said.

During the heated proceedings, several opposition MPs tore copies of the bills and threw them towards Amit Shah, forcing the House to be adjourned until 3 pm. Congress MP KC Venugopal questioned Shah’s morality in the Sohrabuddin case, to which Shah responded that he had resigned from his position before being jailed. Meanwhile, TMC MP Kalyan Banerjee attempted to approach a speaking MP but was stopped by Union MoS Ravneet Singh.

Government of Union Territories (Amendment) Bill, 2025: Seeks to amend Section 45 of the Government of Union Territories Act, 1963 to provide a legal framework for the removal of a Chief Minister or minister in cases of serious criminal charges, as no such provision currently exists.

Constitution (130th Amendment) Bill, 2025: Proposes amendments to Articles 75, 164, and 239AA of the Constitution to allow removal of the Prime Minister, Union Ministers, Chief Ministers, or state ministers if detained for serious offences. The bill addresses the absence of constitutional provisions for such removals.

Jammu and Kashmir Reorganisation (Amendment) Bill, 2025: Amends Section 54 of the Jammu and Kashmir Reorganisation Act, 2019, creating a legal framework for removing the Chief Minister or ministers in Jammu & Kashmir if arrested for serious criminal charges.
