A major political controversy has erupted in Parliament after Aam Aadmi Party (AAP) Rajya Sabha MP Sanjay Singh announced that he will formally approach the Rajya Sabha Chairman seeking disqualification of several party MPs who are reportedly aligning with the Bharatiya Janata Party (BJP).

Taking to X (formerly Twitter), Sanjay Singh stated:

“I will submit a letter to the Rajya Sabha Chairman, in which a demand will be made to declare Raghav Chadha, Ashok Mittal, and Sandeep Pathak disqualified… as this is tantamount to voluntarily relinquishing membership of their original party under the Tenth Schedule of the Constitution.”

His statement comes amid reports that senior AAP leaders, including Raghav Chadha along with Ashok Mittal and Sandeep Pathak, have resigned from the party. Chadha has alleged that nearly two-thirds of AAP’s Rajya Sabha MPs are preparing to merge with the BJP, citing ideological differences as the reason behind the split.

Legal Battle Under Anti-Defection Law

The controversy now hinges on the Tenth Schedule of the Constitution of India, which deals with anti-defection provisions. Under this law, elected members can be disqualified if they voluntarily give up membership of their political party.

However, the same framework includes an exception: if at least two-thirds of legislators of a party agree to merge with another political outfit, it may be considered a valid merger rather than defection—potentially shielding them from disqualification.

Political Crisis Deepens

This development has intensified the internal crisis within AAP, pushing the dispute toward a formal constitutional and procedural showdown. The final decision now rests with the Rajya Sabha Chairman, who will determine whether the alleged switch amounts to defection or a legally valid merger.
